§ 103D.231 — Dismissing Establishment Proceedings

If the Board of Water and Soil Resources decides that creating a proposed watershed district would not help the public, the board must dismiss the petition. A copy of the dismissal order must be sent to the county auditors, the commissioner, and the director.
103D.231 DISMISSING ESTABLISHMENT PROCEEDINGS.
If the board determines that establishment of a proposed watershed district in an establishment petition would not benefit the public welfare and public interest, or would not serve the purpose of this chapter, the board must, by order, dismiss the establishment proceedings. A copy of the order dismissing the establishment proceeding must be mailed immediately to the auditors of counties affected by the proposed watershed district, the commissioner, and the director.

A dismissed petition does not prevent a new petition from being filed later. If your establishment petition is dismissed, review the board’s reasons and consider whether a revised petition could address the board’s concerns.
