§ 103D.255 — Withdrawing Territory

This section lets people petition to remove land from a watershed district. The petition must show that the land has not benefited from the district, is not actually part of the watershed, and the district can work without it. Even if land is removed, it still owes its share of any existing debt.

Practical Notes
Property that was already assessed benefits or damages for a completed project cannot be withdrawn. If your land is removed from a watershed district, you still must pay your share of any existing debt through continued tax levies. A majority of managers can file a withdrawal petition on their own.
