§ 103D.265 — Consolidating Districts

Plain-Language Summary

This section allows two or more neighboring watershed districts to combine into one. All affected districts must sign the petition. After a hearing, the board can order the consolidation. The new district gets all the property, contracts, and debts of the old districts, and five managers are chosen from the former managers.

Practical Notes
Consolidation requires agreement from all affected watershed districts. Existing debts remain tied to the properties that owed them. The first five managers of the consolidated district come from the former districts’ managers and serve one-year terms. The management plans of the old districts automatically become the new district’s plan.
