§ 103D.515 — Preexisting and Improved Water Rights

Plain-Language Summary

People and companies keep their existing water rights when a watershed district is created. However, if the district builds projects that make better water use possible, those improved water rights belong to the district. The district can lease or assign improved water rights for reasonable payment after a public hearing.

Practical Notes
Your existing water use rights are protected when a watershed district is formed. But if the district builds improvements that create new or better water access, those new rights belong to the district. Any lease or contract for improved water rights requires a public hearing with notice to all interested parties.
