§ 103D.615 — Emergency Projects

If there is an emergency that threatens public health or welfare, watershed district managers can declare an emergency and order work to be done right away without going through the normal contract process. The cost can be charged to properties that benefit or raised through a tax on all district property.

Practical Notes
Emergency projects skip the normal petition and contract requirements. The managers must find a clear and imminent danger before declaring an emergency. If the cost is less than 25% of the most recent ad valorem levy and benefits the whole district, it can be funded through a general tax levy rather than special assessments on specific properties.
