§ 103D.635 — Repairs and Improvements Exceeding Normal Maintenance

Plain-Language Summary

When a watershed project needs more than routine maintenance, the engineer must prepare cost and technical specifications. After a hearing, managers can order the repair and assess the cost against benefited properties. A single repair levy cannot exceed the original benefit determination.

Practical Notes
This section applies when repairs go beyond routine maintenance, such as widening ditches or restoring projects to their original condition. The cost is spread proportionally among properties that were originally assessed for the project. The levy for a single repair cannot be more than the original benefits determined.
