§ 103D.705 — Projects Initiated by Petition

The petition must describe the project, show it is needed, and state that petitioners will pay costs if the project does not go forward. Petitioners must deposit at least $2,000 or post a bond. At least 25% of property owners in the affected area must sign.

Practical Notes
Signature requirements vary by project type: 25% of owners for most projects, a majority for new drainage systems, and 26% for drainage improvements. County boards and city governing bodies can also petition. Petitions from county or city governments do not need a bond. Petitioners can withdraw by paying costs.
