§ 103D.745 — Final Hearing

Plain-Language Summary

At the final hearing, the managers hear all parties for and against the project. They can modify the engineer's and appraisers' reports. If they find the project will benefit public health and welfare, comply with the law, and benefit each assessed property more than its cost, they order the project to proceed.

Practical Notes
The managers’ earlier findings are not final and can be changed at the hearing based on evidence. If reports are modified to include new properties, the hearing must be adjourned and new notices sent. The project can be approved as a whole or in separate parts. The hearing recesses until bids are received.
