§ 103D.811 — Bids for Construction

Plain-Language Summary

After a project is approved, managers must advertise for bids. They can accept or reject any bid and award the contract to the lowest responsible bidder. Bids more than 30% above the engineer's estimate cannot be considered. As an alternative, managers can use a best-value request for proposals process.

Practical Notes
The winning bidder must post a bond under section 574.26 guaranteeing completion. Contracts can be awarded in sections or as a whole. The 2024 amendment added the option to use a best-value procurement process under section 16C.28 instead of lowest-bid. All contracts must be in writing and include the engineer’s plans and specifications.
