§ 103D.821 — Bridge or Grade Removal; Passage of Equipment

Plain-Language Summary

When watershed district equipment needs to pass through a bridge or road, managers must give 20 days notice to the bridge or road owner. The watershed district pays the cost of temporarily removing and replacing the structure. If the owner refuses to allow passage, the managers can remove the structure themselves, and the owner is liable for any delay damages.

Practical Notes
The watershed district bears the cost of bridge or grade removal, but the owner must cooperate. If the owner blocks equipment passage, they become liable for resulting delay damages. The district must minimize traffic disruption when removing structures.
