§ 103E.041 — Personal Service in Lieu of Other Methods of Notice

This section allows personal service (hand-delivering a notice directly to a person) to be used instead of other methods of giving notice, such as mailing or publishing in a newspaper. Personal service can be used for any notice required under the drainage law.
103E.041 PERSONAL SERVICE IN LIEU OF OTHER METHODS OF NOTICE.
If notice is to be given under this chapter, personal service at least ten days before the date of hearing may be given in lieu of the manner provided. The notice must be served in the manner provided for the service of summons in a civil action in district court.

Practical Notes
Personal service provides proof that a person actually received the notice, which can be important if there is a dispute later about whether proper notice was given. If you are served personally with a drainage notice, you cannot later claim you did not know about the proceeding.
