§ 103E.051 — Defective Proceedings

Plain-Language Summary

This section addresses what happens when drainage proceedings have defects or errors. Minor mistakes in the proceedings do not automatically make the entire drainage project invalid. The law allows for correction of defects to keep drainage projects from being thrown out over technicalities.

Practical Notes
If you discover a procedural error in a drainage proceeding, it does not necessarily mean the project will be stopped. Courts generally allow minor defects to be corrected. However, if the defect caused real harm to your ability to participate or protect your property rights, you may have a stronger basis for challenging the proceedings.
