§ 103E.075 — Obstructing Drainage System

Plain-Language Summary

This section makes it illegal to block or obstruct a public drainage system. No one is allowed to put things in, build across, or otherwise interfere with the flow of water in a drainage ditch or tile system. If someone blocks a drainage system, the drainage authority can take action to have the obstruction removed.

Practical Notes
Do not place fences, debris, fill, or any other material in a public drainage ditch or over a drainage tile line. If your neighbor is blocking a drainage system, report it to the drainage authority. Obstructions can cause flooding and damage to nearby properties, and the person responsible may be liable for damages.
