§ 103E.238 — County Attorney Review of Petition and Bond

Plain-Language Summary

The county attorney must review each drainage petition and bond within 30 days to check if they meet legal requirements. If the petition has problems, it goes back to the petitioners with an explanation of what needs to be fixed. If it meets requirements, it goes to the drainage authority.

Practical Notes
The county attorney acts as a gatekeeper, catching legal deficiencies early before the drainage authority begins proceedings. If your petition is sent back, carefully address the county attorney’s concerns before resubmitting.
