§ 103E.265 — Order for Detailed Survey and Survey Report

Plain-Language Summary

After the preliminary hearing, the drainage authority orders a detailed survey and appoints viewers to assess benefits and damages, or it dismisses the project. The authority can also order changes to the preliminary plan. If dismissed, petitioners must pay costs incurred so far.

Practical Notes
The drainage authority’s decision after the preliminary hearing is a critical turning point. If the project moves forward, the detailed survey and viewer process will determine how much each property owner pays or receives.
