2025 Session Last amended: 1990 session

§ 103E.535 — Partial Payment of Retained Contract Amounts

Plain-Language Summary

When a drainage system is no longer needed or is causing more harm than good, the drainage authority can abandon all or part of it after a hearing. Property owners receive notice and can object to the proposed abandonment.

Practical Notes
Abandonment ends the public’s obligation to maintain the drainage system. If you rely on a drainage system, oppose its abandonment at the hearing. Once abandoned, the system may deteriorate and affect your property.
