§ 103I.101 — Powers and Duties of Commissioner of Health

Plain-Language Summary

This section gives the Commissioner of Health power to regulate wells and borings in Minnesota. The commissioner licenses contractors, sets construction standards, issues permits, inspects wells, adopts rules, and charges fees. The commissioner must inspect at least 25% of well construction notifications each year.

Practical Notes
If you plan to drill, repair, or seal a well or boring, you need a permit from the Commissioner of Health. The commissioner sets standards for well design, location, and construction. A variance from the rules costs $325 to apply for. All well work is subject to state inspection.
