§ 103I.113 — Applicability to Mining Activities

Plain-Language Summary

This section says that well and boring rules do not apply to mining activities within a permitted mining area, except for wells or borings that withdraw water. The same exemption applies to borings within areas where kaolin clay extraction has a conditional use permit, as long as all bored materials will be removed during extraction.

Practical Notes
If you are conducting mining activities under a valid mining permit, you do not need to follow the well and boring rules for borings within the mining area. However, any well that actually withdraws water must still comply with this chapter, even in a mining zone.
