§ 103I.241 — Action for Well Contamination

Plain-Language Summary

This section gives well owners the right to sue anyone who contaminates their well. The well owner can recover damages for the cost of cleanup, a replacement water supply, and other losses.

Practical Notes
If someone contaminates your well, you have the right to file a lawsuit against the responsible party. You can recover the cost of cleaning up the contamination and providing a new water supply. This creates a private cause of action separate from any government enforcement.
