§ 13.37 — General Nonpublic Data

Plain-Language Summary

This section classifies certain categories of government data as nonpublic (when not about individuals) or private (when about individuals). The protected categories are security information, trade secret information, labor relations information, parking space leasing data, sealed absentee ballots before opening, and sealed bids before the bids are opened. Labor relations information tied to a specific labor organization is classified as protected nonpublic data.

Practical Notes
Not all nonpublic government data is about people. This section protects specific categories: security information, trade secrets submitted to the government, labor relations (collective bargaining) information, parking space leasing data, sealed absentee ballots until opened, and sealed bids until opened. If an agency denies a request by classifying the data as security information, it must, on request, provide a short description explaining why the classification is necessary.
