§ 142A.02 — Creation of the Department of Children, Youth, and Families

Plain-Language Summary

This section creates the Department of Children, Youth, and Families as a new state agency. It makes the commissioner the official state agency for federal Social Security Act programs and the child care and development fund. It also protects state employees who are transferred to the new department.

Practical Notes
Transferred employees keep their job status, classification, union representation, and collective bargaining agreements. If the state sells or transfers any department operations to another entity, affected employees must be offered jobs first and their wages and benefits cannot be cut for at least two years.
