§ 142A.09 — Background Studies on Licensees and Other Personnel

Plain-Language Summary

This section requires background studies for people working at licensed child care facilities, certified child care centers, and legal nonlicensed child care providers. The commissioner of human services conducts the studies and reports results. If someone is disqualified, they can request a reconsideration.

Practical Notes
If you work in child care, you must pass a background study before you can start. If you are disqualified, you have the right to request a reconsideration. The commissioner of children, youth, and families decides reconsiderations for most child care background studies, but the commissioner of human services decides if the facility is also licensed by human services.
