§ 144A.476 — Background Studies

Requires criminal background studies for home care providers. Owners and managerial officials must complete a background study before the state issues or renews a license, and anyone disqualified under chapter 245C may not be involved in the provider's management, operation, or control. Employees, contractors, and volunteers are also subject to background studies and may be disqualified. A provider that fires an employee in good faith reliance on a confirmed conviction is protected from civil liability.

Practical Notes
People with certain criminal convictions may be barred from owning or managing a home care provider.
