§ 144G.45 — Minimum Site, Physical Environment, and Fire Safety Requirements

Plain-Language Summary

All assisted living facilities must meet basic site requirements including access to public utilities, fire department access, and outdoor space for residents. Fire safety requirements include smoke alarms in all sleeping areas with interconnected alarms, and compliance with the State Fire Code. Larger facilities must meet the Life Safety Code standards. Facilities can request variances from physical environment requirements if they can show the variance will not harm residents.

Practical Notes
If you are evaluating an assisted living facility, ask about its fire safety systems — all facilities must have interconnected smoke alarms and comply with the State Fire Code. New construction must meet more stringent Life Safety Code requirements. If you are an operator with a physical environment that does not quite meet the standard requirements, you may apply for a variance from the Department of Health.
