§ 147.131 — Physician Cooperation

Plain-Language Summary

A physician under investigation by the Board of Medical Practice must fully cooperate. This means answering all questions promptly and providing copies of patient medical records when requested. If the board does not have patient consent, the physician must remove identifying patient information before sharing the records.

Practical Notes
A physician who is the subject of a board investigation must respond fully and promptly to its questions and provide patient medical records the board reasonably requests. The board pays for the copies it requests. When the board lacks a patient’s written consent, the physician must delete patient-identifying data before turning the record over. The board keeps any records it obtains as investigative data under chapter 13 (the state data practices act), so they remain confidential.
