2025 Session Last amended: 1995 session

§ 147.161 — Physician Accountability

Plain-Language Summary

The board keeps files on all complaints and reports against physicians. When malpractice settlements or awards are reported, the board may review the physician's practice. The attorney general investigates cases the board initiates. The board can access hospital and medical records with patient consent, or without identifying information if no consent is given.

Practical Notes
Malpractice settlements can trigger board review of a physician’s practice. When the attorney general investigates, the physician and relevant medical facility administrators are notified. Patient privacy is protected by requiring either written consent or removal of identifying information before records are provided to the board.
