§ 148G.17 — Certified Midwife Cooperation

Plain-Language Summary

This section requires certified midwives who are under investigation by the board to cooperate fully with the investigation. This includes answering all questions, providing copies of patient records, and appearing at hearings when required. Failure to cooperate is itself grounds for disciplinary action. The board must pay for the cost of copying records it requests.

Practical Notes
If the Board of Nursing begins an investigation involving you, you are legally required to cooperate. While you must cooperate, you also have rights during the investigation process — consulting with an attorney before responding to board inquiries is strongly advisable. Patient records disclosed to the board during an investigation retain their confidential status.
