§ 152.137 — Fentanyl- and Methamphetamine-related Crime; Children and Vulnerable Adults

Plain-Language Summary

Makes it a felony (up to five years in prison, a fine of up to $10,000, or both) to manufacture methamphetamine, store meth chemicals, waste, or paraphernalia, or expose a child or vulnerable adult to methamphetamine in places where they are present, such as homes, hotel rooms, or multiple-unit buildings. It is also a felony to expose a child (not a vulnerable adult) to fentanyl. Police may take a child found where meth activity is occurring into protective custody, and officers must report suspected maltreatment of an exposed vulnerable adult to adult protection.

Practical Notes
If children or vulnerable adults are present where meth is being made or stored, or if a child is exposed to fentanyl, separate felony charges apply on top of any drug manufacturing charges. Child protection and adult protection agencies must be notified.
