§ 168A.172 — Charitable Interest

Plain-Language Summary

This section allows charitable auto dealers (limited dealers) to retain a recorded interest in a vehicle they donate to someone for free. The charitable interest must be described in a written agreement between the dealer and the recipient, and it is perfected by filing with the vehicle title. When the charitable purpose is fulfilled, the dealer must release the interest within seven days.

Practical Notes
Nonprofit auto programs that donate vehicles to people in need can use this section to retain an interest ensuring the vehicle is used for its intended charitable purpose. The interest appears on the title just like a lender’s security interest. Once the conditions are met, the dealer must promptly release the interest so the recipient has a clean title.
