§ 168A.23 — Suspension or Revocation of Certificate

Plain-Language Summary

The state can suspend or revoke a vehicle title certificate if it was obtained by fraud, if the vehicle has been destroyed, or if the vehicle was transferred without the owner surrendering the title. The owner must return the certificate to the state when notified of the suspension or revocation, and the state can seize the certificate if necessary. Suspending a title does not automatically cancel any lien recorded on it.

Practical Notes
Vehicle owners who receive notice of title suspension or revocation must act quickly to return the certificate or risk further legal consequences. A good-faith buyer who purchases a vehicle with a suspended title (suspended for unpaid sales tax) and does not know about the suspension is protected and can obtain a new title. Lienholders do not lose their security interest just because a title is suspended or revoked.
