§ 176.1362 — Inpatient Hospital Payment

Plain-Language Summary

This section sets the payment rules for inpatient hospital services in workers' compensation cases, generally capping payment at the lesser of the hospital's usual and customary charge or 200 percent of the Medicare MS-DRG amount. For catastrophic, high-cost cases where the hospital's total charges exceed $175,000 (a threshold adjusted annually), payment is instead 75 percent of the hospital's usual and customary charges. Critical Access Hospitals are reimbursed under a separate rule, and the section also covers prompt-payment deadlines, postpayment audits, and interest.

Practical Notes
If you are hospitalized for a work injury, this section controls how much the hospital gets paid through workers’ compensation. Hospitals are paid based on Medicare rates, with adjustments for very expensive stays.
