§ 181.961 — Review of Personnel Record by Employee

Plain-Language Summary

Minnesota employees have the right to see their own personnel file. The employer must let the employee review it within 7 working days of a written request and must provide a free copy if asked. Former employees can review their file once a year after leaving.

Practical Notes
When this applies: When any current or former employee wants to review their personnel record. Who this affects: All Minnesota employees and former employees, and any employer with one or more employees. Key points: Employees must submit a written request to see their file. The employer has 7 working days to comply (14 days if the file is stored out of state). Current employees review the file at or near their workplace; former employees can request a copy be sent to them. The employer cannot charge any fee for copies. Employees can request a review once every 6 months while employed, and once a year after leaving. The employer can only deny access if the request is not made in good faith, and the employer has the burden of proving that.
