§ 245D.09 — Staffing Standards

Plain-Language Summary

This section sets staffing standards for license holders, requiring enough qualified, supervised direct support staff to protect each person's health, safety, and rights and to carry out their support plan. It spells out staff qualification and competency documentation, orientation to program requirements (generally within 60 calendar days of hire, with maltreatment-reporting orientation within 72 hours of first direct contact and annually after that), and orientation to each service recipient's individual needs. It also requires annual training, allows credit for qualifying training from other sources received in the 12 months before hire, and applies training, background study, and supervision requirements to subcontractors, temporary staff, and volunteers; staff under 18 may not perform overnight duties.

Practical Notes
If you receive home and community-based services, the provider must have enough trained and supervised staff to keep you safe and meet the needs in your support plan. Staff must complete orientation (generally within 60 days of hire, and within 72 hours for maltreatment reporting), get yearly training, and meet qualification standards, and the same training and background-study rules apply to subcontractors, temporary staff, and volunteers.
