§ 245G.11 — Staff Qualifications

Plain-Language Summary

Sets the qualifications each type of staff member in a substance use disorder treatment program must meet. It covers treatment directors, alcohol and drug counselor supervisors, alcohol and drug counselors, paraprofessionals, treatment coordinators, recovery peers, volunteers, student interns, individuals working under a temporary permit, and behavioral health practitioners, listing the education, experience, licensure, and training each role requires. All staff with direct client contact must be at least 18 years old, and counselors must be licensed or exempt from licensure under chapter 148F while meeting specified degree, training, and supervised-experience thresholds.

Practical Notes
Qualification paths vary widely by role: for example, an exempt alcohol and drug counselor can qualify through several routes, such as a baccalaureate degree plus 120 hours of classroom instruction and 440 hours of supervised experience, or 270 hours of training plus 880 hours of supervised experience. Treatment coordinators and behavioral health practitioners carry their own supervision requirements, and no more than 50 percent of treatment staff may be student interns or former students. Several provisions (subdivision 6, subdivision 8, and the new subdivision 12 on behavioral health practitioners) carry delayed or federal-approval-dependent effective dates noted at the end of the section.
