§ 260.761 — Inquiry of Tribal Lineage; Notice to Tribes, Parents, and Indian Custodians; Access to Files

Plain-Language Summary

When a child welfare case may involve an Indian child, the agency or court must ask the child, parents, and custodians about tribal lineage and keep asking throughout the case. The agency must notify the child's Tribe, parents, and Indian custodians, including notifying a Tribe within seven days when it learns a child receiving services may be an Indian child and immediately, no later than 24 hours, if an Indian child goes missing. A Tribe, parent, or Indian custodian may request up to 20 additional days to prepare for a hearing, and the Tribe has the right to intervene at any point and to access the child's files.

Practical Notes
