§ 260C.619 — Communication and Contact Agreements

Plain-Language Summary

This section lets an adopting parent enter a written agreement for communication or contact between the adopted child and a birth parent, a relative or foster parent the child lived with before adoption, or the child's siblings. Such an agreement is enforceable only when its terms are put in a written court order issued before or at the time the adoption decree is granted, and the court must find the contact is in the child's best interests and that all required parties (including the responsible social services agency) approved it in writing. The agreement need not disclose the parties' identities to be enforceable. Failure to comply with the order is not grounds to set aside the adoption decree or revoke an irrevocable consent, but the order can be enforced by motion in the adoption file (with possible attorney fees to the prevailing party) and modified only to serve the child's best interests.

Practical Notes
These are open-adoption contact agreements: they only bind if reduced to a court order entered at or before the adoption decree and filed in the adoption file. Breaking the contact order does not undo the adoption or a finalized consent; the remedy is a motion to enforce, and the court can modify the order only on a best-interests showing plus either party agreement or exceptional changed circumstances.
