§ 260C.215 — Welfare of Children

Plain-Language Summary

This section requires child-placing agencies to make special efforts to recruit foster and adoptive families, including from a child's relatives and from communities that reflect the ethnic and racial diversity of children needing homes. It sets duties for the commissioner (training curricula, home study formats, licensing guidelines) and for agencies (written recruitment and training plans, Indian Child Welfare Act compliance, data reporting within 15 days). It also requires that children in foster care be protected from secondhand smoke in licensed foster homes and vehicles. The special effort to locate relatives is satisfied either when the child is placed with a relative willing to provide permanent placement or after six months of special efforts approved by the court.

Practical Notes
If your child is placed in foster care, the agency must make special efforts to find a relative or a family that reflects your child’s ethnic and cultural background, and to prepare and train that family for the child’s needs. Foster homes and vehicles must be kept smoke-free to protect children, though this requirement cannot be used to delay placement with a relative or to override the Indian Child Welfare Act.
