§ 268B.03 — Payment of Benefits

Plain-Language Summary

This section lists the requirements a person must meet to receive paid leave benefits. The applicant must file an application, meet ongoing eligibility rules, not have unpaid overpayments from fraud, and not be found ineligible. Benefits are paid from state funds, not from the employer.

Practical Notes
Benefits are treated as a request to the state, not a claim against your employer. The commissioner decides who gets benefits based on all available information, without putting the burden of proof on either side. Any agreement between you and your employer does not control whether you get benefits.
