§ 325C.06 — Statute of Limitations
Plain-Language Summary
This section sets the statute of limitations for trade-secret misappropriation claims under Minnesota's Uniform Trade Secrets Act. A claim must be brought within three years after the misappropriation is discovered or reasonably should have been discovered. A continuing misappropriation is treated as a single claim rather than a series of separate violations.
325C.06 STATUTE OF LIMITATIONS.
An action for misappropriation must be brought within three years after the misappropriation is discovered or by the exercise of reasonable diligence should have been discovered. For the purposes of this section, a continuing misappropriation constitutes a single claim.

Practical Notes
The three-year clock can begin before the harmed party has actual knowledge, because it also runs from when the misappropriation should have been discovered through reasonable diligence. Because ongoing misuse counts as one continuing claim, the deadline is generally measured from the initial discovery rather than restarting with each later act of misuse. Anyone concerned about a possible trade-secret claim should track discovery dates carefully and confirm the current deadline in the Minnesota Statutes.
