§ 325F.781 — Requirements; Tobacco Product Delivery Sales

Plain-Language Summary

This section sets the rules for selling tobacco products to Minnesota consumers by mail, phone, or internet (delivery sales). Before shipping, a retailer must verify the buyer's name, address, photo, and date of birth against a commercial database, get a signed age statement, and receive payment by credit card or check. Packages must be marked "tobacco products - adult signature required," and the delivery service must require an adult of legal age to sign and show photo identification. Out-of-state retailers must register with the commissioner of revenue and pay all taxes under chapter 297F; civil fines run up to $1,000 for a first violation and up to $5,000 for later ones, with repeat violations after a cease and desist order becoming a misdemeanor or gross misdemeanor.

Practical Notes
This statute regulates remote (mail, phone, and internet) sales of tobacco products to Minnesota consumers, covering age and identity verification, shipping and adult-signature requirements, out-of-state retailer registration, tax collection under chapter 297F (with a 50 percent penalty for unpaid tax), forfeiture of noncompliant product, and enforcement by the attorney general, including treatment as an Unlawful Trade Practices Act violation.
