§ 336.4-210 — Security Interest of Collecting Bank in Items, Accompanying Documents, and Proceeds

Plain-Language Summary

A collecting bank has a security interest in a deposited item, any documents that come with it, and the proceeds, to the extent it has let the customer withdraw or use the credit given, or to the extent it has made an advance against the item. When credit for several items is partly used, the security interest stays on all of them, and the credit given first is treated as withdrawn first. The bank realizes on this security interest when it receives final settlement, and while the interest continues no security agreement or filing is needed and it has priority over conflicting perfected security interests in the item, documents, or proceeds.

Practical Notes
If your bank lets you withdraw or spend money from a deposited check before the check clears, the bank automatically holds a security interest in that check and its proceeds to protect itself, without needing any paperwork or filing.
