§ 357.021 — Court Administrator of District Court; Fees

Plain-Language Summary

This section sets the fees the district court administrator charges and collects for filing lawsuits, motions, and other court business, and directs how those fees are distributed. The fee for filing the first paper in a civil action or proceeding is $310, except in marriage dissolution actions where it is $340; filing or responding to a motion in civil, family, and guardianship cases is $100 (or $50 for a child support modification). The court administrator transmits the fees monthly to the commissioner of management and budget for deposit in the state general fund, with specified exceptions. The section also imposes a $75 surcharge on most criminal and traffic convictions, with a $12 surcharge for vehicle parking violations.

Practical Notes
Public authorities and federally recognized Tribes do not have to pay these fees for certain public-interest matters, including child support enforcement, civil commitment, public guardianship, and juvenile court relief. In dissolution (divorce) cases, $30 of the filing fee goes to the Minnesota Family Resiliency Partnership. A $75 surcharge is imposed on most felony, gross misdemeanor, misdemeanor, and petty misdemeanor convictions, while vehicle parking violations carry a smaller $12 surcharge; the court may reduce or waive the surcharge for indigency or undue hardship.
