§ 363A.21 — Exemption Based on Real Property

Plain-Language Summary

Some housing situations are exempt from discrimination rules. A nonprofit-run residence home can limit rooms by sex. A person renting a room in their own home can choose tenants based on sex, gender identity, marital status, public assistance status, sexual orientation, or disability. Housing for people 55 or older, or 62 and older, is exempt from familial status discrimination rules.

Practical Notes
These exemptions are narrow. Most landlords and property managers are still fully covered by the Human Rights Act. The familial status exemption applies to owner-occupied buildings with four or fewer dwelling units and to qualifying housing for elderly persons (62 and older, or 55 and older where at least 80 percent of units meet the age requirement). A separate exemption lets a resident owner who rents out a room in their own one-family home select tenants on certain bases.
