§ 364.021 — Public and Private Employment; Consideration of Criminal Records

This is Minnesota's 'Ban the Box' law. Both public and private employers cannot ask about your criminal record on a job application or before an interview. If there is no interview, they cannot ask until they make a conditional job offer.

Practical Notes
This protection applies to most employers but does not apply to the Department of Corrections or jobs where a background check is required by law. Employers can still tell applicants that certain criminal histories may disqualify them from specific positions.
