§ 430.05 — Council May Abandon; Effect on Awards

Plain-Language Summary

This section allows a city council to abandon a land acquisition proceeding or rescind a pedestrian mall ordinance within 90 days after the final court decision in any appeal. If the city abandons the project, all awards and assessments are canceled and any work already started is stopped.

Practical Notes
If a city decides not to proceed with a street or park improvement after the process has already started, affected property owners should know that their damage awards will be set aside and any assessments canceled. Contractors and property owners who have relied on the project should be aware of this abandonment right.
