2025 Session Last amended: 2007 session

§ 462.353 — Authority to Plan; Funds; Fees; Appeal

Plain-Language Summary

Cities and towns may carry on comprehensive planning to guide future development and may adopt, amend, and implement a comprehensive municipal plan by ordinance. A municipality may charge fees to cover the cost of reviewing zoning amendments, permits, and other approvals, and those fees must be fair, reasonable, and proportionate to the actual cost of the service. A municipality that collects $5,000 or less per year in these fees may set them by a fee schedule rather than ordinance. A person who disputes a specific fee may appeal under section 462.361, but the appeal must be brought within 60 days after the application is approved and the fee is deposited into escrow.

Practical Notes
Cities can plan, zone, and charge reasonable fees for building permits and zoning reviews.
