§ 481.13 — Lien for Attorneys' Fees

Plain-Language Summary

Gives attorneys a lien on a client's case to secure payment of legal fees.

Practical Notes
An attorney has a lien for compensation on the cause of action (from service of the summons or commencement of the proceeding), on the client’s interest in money or property involved in the case, and on any judgment (from the time notice of the claim is given to the judgment debtor). To perfect the lien against real property, a notice of intent to claim must be filed and the owner notified within 30 days, with no notice allowed more than 120 days after the last item of the claim. A lien on real property must be asserted within one year of filing the notice of intent and in no event more than three years after filing.
