2025 Session Last amended: 1997 session

§ 518.11 — Service; Alternate Service; Publication

Plain-Language Summary

This law explains how divorce papers must be delivered to the other spouse. Usually the papers must be handed to the person directly, but if that person cannot be found, the court can allow service by mail or publication in a newspaper.

Practical Notes
When this applies: At the start of a divorce or legal separation, when the petition and summons must be delivered to the other spouse. Who this affects: Any person filing for divorce or legal separation in Minnesota. Key points: Personal service (handing papers directly to the other spouse) is required unless the court allows an alternative. If the other spouse cannot be found, the petitioner must show the court what efforts were made to locate them. The court may then allow service by first class mail or newspaper publication. Service is considered complete 21 days after mailing or publication.
