§ 518A.44 — Notice to Public Authority

Plain-Language Summary

This section requires the petitioner in a dissolution, legal separation, parentage, or child custody proceeding to notify the public authority whenever either party is receiving public assistance or applies for it after the proceeding begins. The notice must include the parties' full names, Social Security numbers, and birth dates. Once notified, the court sets child support under the statutory guidelines and may order either or both parents to pay support without regard to marital misconduct.

Practical Notes
When this applies: in a divorce, legal separation, parentage, or custody case where one of the parties receives public assistance or applies for it during the case. Who this affects: the petitioner, who carries the duty to notify the public authority, and parents who may be ordered to pay support. Key points: the notice must contain each party’s full name, Social Security number, and birth date; after receiving it, the court sets child support under the guidelines; the court will generally approve a support stipulation when both parties have independent counsel and the stipulation meets the guideline conditions; otherwise the court orders a specific dollar amount, and it may also order support as a percentage of bonuses, commissions, or other compensation.
