§ 524.2-1108 — Disclaimer of Interest in Property

Plain-Language Summary

When a person disclaims an interest in property, the property passes as if the person who disclaimed had died before the event that created the interest.

Practical Notes
If you disclaim an inheritance, the property passes as if you died before the person who left it to you. This means it may go to your children or to the next person named in the will.
